Brexit – what now?

The EU (Withdrawal) Act 2018 and EU (Withdrawal) Act 2020 contain provisions that put any changes on hold until the implementation period is complete.

The implementation period runs to 11pm on 31 December 2020 (unless extended). The UK and EU will use this time to negotiate the terms of their future relationship based on the Withdrawal Agreement and non-binding Political Declaration.

During the implementation period there will be no immediate change to:

• Right to work checks – you can still use an EU citizen’s passport or ID card

• Immigration – a new system will apply from 1 January 2021

• Data protection

• Employment legislation based on European law, e.g. holiday pay rights

After the implementation period the ECJ will:

• Retain jurisdiction over EU citizens’ rights living and working in the UK and UK nationals living and working in the EU (for people in the UK/EU before 31 December 2020)

• Be able to give an interpretation on EU/UK citizens’ rights for eight years after 31 December 2020

• Possibly retain jurisdiction on the Protocol on Ireland/Northern Ireland indefinitely

• Retain jurisdiction over cases pending before them, including appeals

• For four years, retain the right to hear cases brought by the European Commission against the UK for infringements that took place during the implementation period

• Be able to interpret EU law in relation to disagreements about the Withdrawal Agreement – unless it can be resolved via consultation or arbitration panels

Any judgment by the ECJ during the implementation period or within four years after it will be binding on the UK.

What about the future relationship?

The ECJ won’t have general jurisdiction over the UK in relation to any acts on or after 1 January 2021. Anything further is yet to be negotiated.

Talking point...

IR35 payment date

HMRC have announced that the private sector IR35 changes will now only apply to services supplied on or after 6 April 2020. The previous position was that the changes applied to any payments made on or after 6 April 2020 regardless of when the services were provided. The new position is more beneficial because it now means that payments don’t have to be rushed through prior to the changes. Payment for outside IR35 services supplied prior to 6 April 2020 can now be paid after 6 April 2020 but still taxed under the current rules not the new rules.
